Introduction

Village App Co., LLC (“villco”, “we,” “our,” or “us”) respects your privacy and is committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when using the villco App or when you visit our website, www.villcoapp.com, or related web pages and applications (collectively, our “App”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

This policy applies to information we collect:

  • Through use of our App.
  • In e-mail, text and other electronic messages between you and villco.
  • When you interact with our advertising and applications on third-party apps, websites and services, if those applications or advertising include links to this policy

It does not apply to information collected by any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the App.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our App. By accessing or using our App, you agree to this privacy policy. This policy may change from time to time (see Changes to our Privacy Policy). Your continued use of our App after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Individuals Under the Age of 13 and other Minors

Our App is not intended for individuals under 13 years of age. No one under age 13 may provide any information to or on the App. We do not knowingly collect personal information from those under 13. If you are under 13, do not use or provide any information on our App or on or through any of its features/register on the App, make any purchases through the App, use any of the interactive or public comment features of the App or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from an individual under 13, we will delete that information. If you believe we might have any information from or about an individual under 13, please contact us at hello@villcoapp.com.

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information.  Please see Your California Privacy Rights, below, for more information about this.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our App, including information:/p>

  • by which you may be personally identified, such as name, postal address, e-mail address, or telephone number, location, demographic information, photographs, video and other recorded footage, certifications, emergency contact information, credit card and other payment and bank information,  any other identifier by which you may be identified and/or contacted online or offline (“personal information”);
  • that you provide to us, as more thoroughly described below, and
  • about your internet connection, the equipment you use to access our App and usage details.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the App. Information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons and other tracking technologies.

Information You Provide to Us. The information we collect on or through our App may include:

  • Information that you provide when you create an account, create or edit your profile, upload content or comments, complete a registration, or subscribe to the App.
  • Information that you provide in connection with offering or obtaining the Services provided by the App.
  • We may also ask you for information when you report a problem with our App.
  • Records and copies of your correspondence (including e-mail addresses), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the App, or transmitted to other users of the App or to third parties (collectively, “User Contributions”).  Your User Contributions are posted on and transmitted to others at your own risk.  We limit access to certain pages and you may set certain privacy settings for such information. However, we cannot control the actions of other users of the App with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect through Automatic Data Collection Technologies. As you navigate through and interact with our App, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

  • Details of your visits to our App, including traffic data, location data, logs and other communication data and the resources that you access and use on the App.
  • Log information about your use of the App, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to the Service. We do link this automatically collected data to other information we collect about you. We do this for many reasons, including without limitation to improve services, marketing, analytics, and site functionality.
  • When you download and use our Services, we automatically collect information on the type of device you use and operating system version.
  • We and our partners, affiliates, tracking utility companies and service providers use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Users can control the use of cookies at the individual browser level. Cookies are small data files stored on your hard drive or in device memory that help us to improve the App and your experience, see which areas and features of the App are popular, count visits and track user activity among other things. For more information about cookies, and how to disable them, please see Choices about How We Use and Disclose Your Information We may also collect information using web beacons (also known as “tracking pixels”) and digital fingerprinting. Web beacons are electronic images that may be used on the App or emails and help deliver cookies, count visits, understand usage and campaign effectiveness and determine whether an email has been opened and acted upon. Digital fingerprinting technology enables us to identify the devices that you use to access the App for purposes such as data analytics, delivering targeted content and advertising, and protecting against possible fraudulent transactions.
  • We may also collect third-party contact information if you permit the App to import such information or otherwise upload such information for your use within the App or so that you may invite your contacts to use the App or participate in other referral services. This information may include, but is not limited to, such third party’s name and basic contact info, as well as Facebook ID. We use this information only as described in this paragraph.
  • We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the App, the events that occur within the App, aggregated usage, performance data, and where the App was downloaded from.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our App and its contents to you.
  • To provide you with information that you request from us.
  • To provide you with customized site content, targeted offers, and other personalized or general marketing.
  • To respond to your inquiries.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account, including expiration and renewal notices.
  • To notify you about changes to our App or any products or services we offer or provide though them.
  • To allow you to participate in interactive features on our App.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • If you choose to make certain information public or available to other users, such as by creating a profile, posting a job, creating a review, and/or posting or sharing information in public or private forums or features in the App, such information will be available to other users. To request removal of your personal information from our App, contact us at hello@villcoapp.com.
  • To our subsidiaries and affiliates.
  • To contractors, service providers and other third parties, such as payment processors, who need access to such information to carry out work on our behalf.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of villco’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by villco about our App users is among the assets transferred.
  • To fulfill the purpose for which you provide it. For example, if you give us an e-mail address to use the “refer a friend” feature of our App, we will transmit the contents of that e-mail and your e-mail address to the recipients.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use found on our App or by clicking Term-Condition and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of villco, our users or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Referrals

If you choose to use our referral service, we will ask you for your friend’s email address. We will automatically send your friend an email inviting him or her to visit the App. villco stores this information for the sole purpose of sending this email and tracking the success of our referral program. Your friend may contact us at hello@villcoapp.com to request that we remove this information from our database.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We provide the following mechanisms to accommodate certain choices you make about our use of your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of our App site may then be inaccessible or not function properly.  Please also note that if third parties have content embedded on our websites such as a social feature, they may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited our App from a certain IP address.
  • Promotional Offers from villco. If you do not wish to have your e-mail address/contact information used by villco to promote our own or third parties’ products or services, you can opt-out by sending us an e-mail stating your request to hello@villcoapp.com. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. 
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an e-mail stating your request to hello@villcoapp.com.

Choices About Deleting, Accessing, and Correcting Your Personal Information

·        You can review and change your personal information by logging into the App and visiting your account profile page.

·        You may also send us an email at hello@villcoapp.com to request access to, correct or delete, or object to processing of any personal information that you have provided to us.  Deleting your personal information may also require deletion of your user account.  We will respond to your request as required by applicable law. 

Data Retention

By using our App you grant us the right to retain your information. This right will survive termination of your subscription and your use of our App. Typically, we retain your personal information for the period necessary to provide you with access to the App and to otherwise fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law.  In addition, we may keep your personal information as needed to comply with our legal obligations, resolve disputes, and/or enforce our agreements.  The precise periods for which we keep your personal information vary depending on the nature of the information and why we need it.

Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.  Pursuant to California Civil Code Section 1798.83, we do not share your personal information with third parties for their direct marketing use. If you are a resident of California, you may request information regarding our disclosure of your personal information to third parties for the third party’s direct marketing purposes by contacting us at hello@villcoapp.com.  Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a username and password in order to register for our App, you are responsible for keeping this information confidential. We ask you not to share your username and password with anyone. We urge you to be careful about giving out information in public areas of the App. The information you share in public areas may be viewed by any user of the App.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the App home pages. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the App home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you, and for periodically visiting our App and this privacy policy to check for any changes.
